US Customs & Import Guide

How to legally import robots from China into the US: HTS classification, Section 301 tariffs, FCC Form 740, and the documents customs actually checks.

1.Overview — what customs requires

Every shipment of robots into the US passes through CBP (US Customs and Border Protection). Three things determine whether it clears: (a) correct HTS code + duty payment, (b) FCC compliance evidence, (c) all required regulatory paperwork. Get any one wrong and CBP can detain, seize, or send the shipment back at your expense.

2.HTS classification — which code applies

The HTS (Harmonized Tariff Schedule) determines duty rate and any Section 301 tariffs. Misclassification is the single most common customs mistake — and it's expensive (back duties + penalties).

Always verify on hts.usitc.gov — the table above is a 2026 reference. CBP can issue binding rulings via the CROSS database.

3.Section 301 China tariffs

Since July 2018 the US has imposed an additional 25% ad valorem duty on most robotics products imported from China under Section 301 (USTR's response to alleged unfair trade practices). The 25% rate is on top of the standard MFN duty. Reporting requires the Chapter 99 sub-heading 9903.88.03 alongside the standard HTS code at entry.

⚠️ Real-world example

A $200 wholesale robot vacuum from China: $0 MFN duty + $50 Section 301 duty + ~$10 MPF (merchandise processing fee) + customs broker fee = ~$60-80 in landed cost markup per unit.

Exclusions

Some HTS lines have temporary or permanent exclusions from Section 301. The list changes — check USTR's exclusion search before assuming your product is covered. Medical devices have had broader exclusions historically.

4.FCC Form 740 — import declaration for RF devices

Any shipment containing radio-frequency devices (Wi-Fi, Bluetooth, cellular — virtually every robot) must include FCC Form 740 with the customs entry. The form declares one of three statuses: (1) device has FCC authorization, (2) device is excluded/exempt, or (3) device is for personal use / R&D / repair.

Common Form 740 mistakes

  • Filing 'exempt' for a Wi-Fi device — auto-flagged. CBP will detain.
  • FCC ID typo on Form 740 — won't match the FCC database lookup.
  • Importing samples without 'R&D' status — gets stuck without FCC Form 740 R&D box checked.
  • First-time importers without an EIN — slows everything by 1-2 weeks.

5.Customs broker + required documents

Foreign exporters MUST use a US-licensed customs broker for commercial entries above $2,500. The broker files the customs entry, calculates duties, posts the bond, and represents you to CBP.

Document checklist for every shipment

  • Commercial invoice
  • Packing list
  • Bill of lading / airway bill
  • FCC Form 740 (RF devices)
  • Importer of Record EIN / IRS ID
  • Customs bond ($50K minimum, single-entry $100+)
  • FDA Prior Notice (medical devices only)
  • Country of origin marking on each unit
  • Power supply / battery UN 38.3 cert (Li-ion)
  • MSDS for any hazardous materials

6.Import process (6 steps)

1

Get an Importer of Record EIN

Foreign companies without a US presence can apply via IRS Form SS-4. Takes 1–2 weeks via fax (faster than mail).

⏱️ 1–2 weeks💰 $0
2

Classify HTS code

Look up on hts.usitc.gov OR file a Binding Ruling Request via CBP CROSS for legal certainty.

⏱️ 1 day – 4 weeks💰 $0 – $500
3

Hire a customs broker

Required for foreign importers. Broker files entry, calculates duties, posts bond. Annual continuous bond saves $$.

⏱️ Same day💰 $300–$2K setup
4

Prepare shipping documents

Commercial invoice, packing list, BoL, FCC Form 740, country-of-origin labels. Have FCC ID + UL listing on the product.

⏱️ 1 week💰 Internal
5

Customs entry filing

Broker files via ABI (Automated Broker Interface). Status checked on ACE portal within 24 hours.

⏱️ 1–3 days💰 Broker fee included
6

Pay duties + release

Duties paid via ACH or to broker. CBP releases shipment to your warehouse / Amazon FBA / 3PL.

⏱️ 1–2 days💰 Per duty calc

8.Frequently asked questions

  • Can I avoid Section 301 by transshipping through Vietnam?

No — CBP rules of origin look at where SUBSTANTIAL TRANSFORMATION occurs. Just relabeling in Vietnam doesn't change country of origin. CBP enforces aggressively.

  • What's a customs bond?

A guarantee that you'll pay duties owed. Required for any commercial entry. Continuous bonds (annual) start at $50K coverage; single-entry bonds are $5 per $1,000 of cargo value.

  • Do I pay duty on FCC test samples?

Generally yes — but you can apply for Temporary Import Bond (TIB) which suspends duty for up to 1 year if you re-export.

  • How much is the customs bond?

    Continuous: $300–$700/year for $50K coverage. Single-entry: $5 per $1,000 of merchandise value (min $100).

  • Can the broker classify HTS for me?

They'll suggest one but legal liability is on the importer. For high-value SKUs, file a CBP Binding Ruling for legal certainty.

  • What's an EIN and how do I get one?

Employer Identification Number — IRS-issued tax ID. Foreign companies file IRS Form SS-4 by fax (fastest, 1-2 weeks). Free.

  • Do I need an FDA Prior Notice for medical robots?

Yes for any FDA-regulated device. File via FDA's Prior Notice System Interface (PNSI) at least 8 hours before air arrival.

  • What if my shipment gets detained?

CBP issues a Notice of Detention. You have ~30 days to respond with the requested documents. After that, the shipment can be seized and destroyed at your cost.

  • Can I import for personal use without all this?

De minimis: shipments ≤$800 are duty-free and need minimal paperwork. Above $800 = full formal entry. Section 301 still applies though.
